Terms and Conditions

These Terms and Conditions ("Terms") govern the use of services provided by Discover Marketing ("we", "our", or "us") to customers ("you", "your", or "client"). By accessing and using our services, you agree to comply with and be bound by these Terms.


1. Services Provided

Discover Marketing offers website design, website management, local marketing services, and related services, including but not limited to website hosting, SEO, and ongoing website maintenance.


  • Included in Website Design & Development:


  • Custom Website Design: A professionally 5 Page designed website that reflects your business, including the layout, color scheme, and structure tailored to your brand.
  • Responsive Design: A website that automatically adapts to all devices (desktop, tablet, mobile).
  • On-Page SEO Setup: Basic on-page SEO to help improve your website’s search engine visibility.
  • SSL Certificate: Ensures your website is secure and trustworthy for visitors.
  • Domain Setup Assistance: We assist with connecting your domain to the website.
  • Website Hosting: Your website will be hosted on AWS, ensuring speed, reliability, and security.

  • About Us
  • Services/Products

  • Gallery/Portfolio


  • Included in Monthly Website Management:


  • Ongoing Hosting: Continued hosting on AWS, ensuring reliable uptime and performance.
  • Regular Updates & Monitoring: We monitor your website for issues and ensure it stays functional at all times.
  • DIY Editor Access: You will receive access to our easy-to-use DIY Editor to make quick content updates on your website (e.g., text, images, and simple changes).
  • Form Management: A contact form for inquiries and the ability to manage and respond to form submissions through your website dashboard.
  • Analytics Access: View your website's performance, including visitor statistics, through Google Analytics integration.


  • Content Limitations and Responsibilities

To ensure we stay on track with your affordable setup and monthly fees, we have set clear guidelines on what’s included in your 5-page website:


  • Page Content: The 5 pages included in your website are designed to be streamlined, showcasing essential information about your business. We will work with you to fill in the content for each page, but we limit the amount of content to what is necessary and relevant. This includes a concise write-up for your business, a brief description of your services/products, and contact details. Any additional pages, large amounts of content, or extensive revisions may require an additional fee.
  • Gallery Page: Your website includes a Gallery/Portfolio page, which is set up as a spreadsheet. This spreadsheet allows you to easily add and manage photos without needing technical knowledge. We will show you how to update it so that your website automatically updates with your new photos. You are responsible for providing the images—we do not include unlimited image uploads.
  • Content Responsibility: You are responsible for the content you provide, including text, images, and descriptions. This means you will need to supply the written content for your About Us page, services/products descriptions, and any other page text. However, we can assist by gathering basic information and writing clear content for you if needed. We can also provide a limited selection of stock photos for your website, but if you require additional or custom photos, you will need to source or purchase them.


  • Website Updates, Additional Features and Custom Requests

We understand that your business may grow and evolve, and you may need additional features or changes to your website over time. Here’s how we handle extra requests:


  • Adding Extra Features or Pages

If you’d like to add more functionality or pages to your website, such as:


  • Additional Pages (e.g., FAQ page, testimonial page, etc.)
  • Menu Integration (e.g., for restaurants or cafes)
  • Booking Software Integration (e.g., booking system for services)
  • Blog Integration
  • Any other custom feature


We offer these additions at either a flat fee or an hourly rate, depending on the complexity of the request. These additional costs will be quoted separately and invoiced in advance before work begins, ensuring no surprises. All pricing will be transparent and clearly outlined in the quote.


  • Changes and Updates to Website

For any updates or changes you request to your website, whether big or small, we charge an hourly rate of $175/hour. This covers everything from simple changes, like updating your hours of operation, to more complex updates. For example, a small change such as adjusting your hours of operation may only take 5 minutes, resulting in a very low fee. Note: We often include these types of minor updates free of charge, at our discretion. However, if the changes require more time or are more involved, they will be billed at the hourly rate. As a reminder, you also have the ability to make changes yourself, free of charge, via our DIY Editor Tool. See below for more information.


  • Flat Setup Fee & Monthly Maintenance Fee

Despite any added services or features, your monthly maintenance fee will remain the same, and will not increase with the addition of new pages or features. We believe in keeping things simple and affordable for you.


However, if you decide to integrate third-party services—such as booking software, a reservation system, or other paid services—please note that you may be responsible for any monthly or usage fees charged by those third-party providers. We will inform you of any such charges in advance and include them in your quote.


  • Clear Communication & Approval Process

Before any additional work or feature is started, we will always provide a detailed quote, including the cost and scope of work. You will need to approve the quote before we move forward, so you can make informed decisions without any surprises. We prioritize transparency and communication to ensure you're happy with every step of the process.


2. Payment Terms


  • Setup Fee: A one-time $129 setup fee is required prior to the commencement of services. This fee covers the design, development, and setup of your website.


  • Monthly Management Fee: A $99 monthly fee will be charged for ongoing services including website hosting, SSL certificate, SEO, website analytics, form management, and access to our DIY Editor.


  • Payment Methods: Payments must be made via the payment method agreed upon during the setup process. You agree to provide accurate, up-to-date billing information.


  • Non-Refundable Fees: The setup fee is nonrefundable, except in rare cases where no work has been initiated. The monthly management fee is nonrefundable, but you may cancel at any time.


3. Service Cancellation


  • Cancellation by You: You may cancel our services at any time by notifying us in writing. Upon cancellation, you will no longer be charged for future monthly payments. However, the setup fee is nonrefundable, and no partial refund will be given for services rendered up to the point of cancellation.


  • Ownership of Website: All websites created by Discover Marketing are the property of Discover Marketing. Upon cancellation, we will deactivate your website, and it will no longer be live. Should you choose to return or reactivate your website in the future, a new setup fee and monthly management fee will apply.


  • Cancellation by Us: We reserve the right to cancel services at any time, with or without cause. In cases of non-payment, violation of terms, or any other reason, we may immediately suspend or terminate your account, deactivate your website, and discontinue services. We will notify you via email of any such action. If services are terminated due to non-payment or other violations, you will not be entitled to a refund of any fees paid.


4. Non-Payment and Late Fees


  • Non-Payment: If payment is not received by the due date, we reserve the right to suspend or terminate services. Any suspended or terminated services due to non-payment will not be reinstated until all outstanding payments are made, including any applicable late fees.


  • Late Fees: Payments that are more than 30 days overdue will incur a $25 late fee.


  • Reinstatement Fee: If your website is cancelled due to non-payment, we charge a $129 reinstatement fee to restart services.


5. Website Content and Usage


  • Client Responsibility: You are responsible for all content you submit to your website, including images, text, and links. Discover Marketing is not liable for any content violations, including copyright infringement, unlawful content, or content that violates any laws or regulations.


  • DIY Editor Usage: Our DIY Editor is designed to be easy to use and give you control over your website updates. However, you are solely responsible for any changes or edits made using the DIY Editor. While the tool is user-friendly, we cannot and will not be held responsible for any mistakes, errors, or unintended changes made by you through the editor.


  • Support and Fixes: If you make changes that result in errors or need assistance, we’re happy to help! However, please note that any fixes to mistakes made using the DIY Editor will be subject to an additional fee at our standard hourly rate. We strongly advise that you only make changes using the DIY Editor if you are confident in what you are doing. If you’re unsure, please reach out to us for assistance or guidance before making updates.


  • Legal and Policy Documents: While we can guide you in purchasing or obtaining necessary legal documents such as Terms and Conditions, Privacy Policies, or Cookie Policies, it is important to understand that we are not responsible for the accuracy, completeness, or compliance of these documents with any applicable laws or regulations. We strongly recommend consulting with a legal professional to ensure your website meets all legal requirements.


6. Confidentiality and Data Protection

We are committed to protecting your privacy. We will never sell or share your personal information with third parties except as required for payment processing or as needed to provide the services we offer. Any personal data we collect will be handled in accordance with our Privacy Policy.


7. Limitation of Liability

To the fullest extent permitted by law, Discover Marketing is not liable for any indirect, incidental, special, or consequential damages arising from the use of our services. This includes, but is not limited to, lost profits, loss of business, or damage to reputation.

Our total liability for any claim, loss, or damage related to our services is limited to the total amount paid by you for the specific service in question during the six-month period preceding the claim.


8. Indemnification

You agree to indemnify, defend, and hold harmless Discover Marketing, its employees, and agents from any and all claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of our services, violation of these Terms, or the content you upload to your website.


9. Changes to Terms

We reserve the right to modify or update these Terms at any time. Any changes to the Terms will be communicated to you via email. Continued use of our services after such changes have been made constitutes your acceptance of the updated Terms.


10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California. Any disputes relating to these Terms will be subject to the jurisdiction of the courts located in San Bernardino County, California.
